How do I know if I am eligible for a visa?

According to the type of visa you are applying for, the requirements change. For example, if you were trying to apply for a study visa, then it would be imperative that you have been accepted by a school or university and enrolled. If you are seeking to enter Australia under a work visa, you will need to have obtained employment. It is imperative that you continue your employment or education during the period of the visa. Failing to do so could result in your visa being cancelled and your deportation.

What Visa Options Are Available to me?

Various visa types are available for entry into Australia, the criteria and eligibility for each being determined by the respective visa type. Here is a list of possible visa categories and their various visa options:

  • Visitor or Tourism Visa;

  • Study Visa;

  • Work Visa;

Where can I find information about the Migration System?

In order to learn more about the migration process and system in Australia, you must review the Migration Act 1958. In the act, you will learn how Australian migration law applies to your individual circumstances. The code of conduct for the legal profession will also be included, including obligations of legal practitioners and professional standards. A migration lawyer can help you navigate the legislation if you are unsure.

Is it necessary for my migration agent to be registered?

You should use a registered immigration agent if you choose to use one to help you with your visa application. A registered migration agent is required to stay up to date on current legislation and processes. You can only get immigration assistance from a registered migration agent. Immigration assistance includes:

  1. Preparation of visa applications;

  2. Visa application advice;

  3. Providing advice to a sponsor on the preparation of documents for the sponsorship of a visa applicant;

  4. Representing someone in proceedings before a court or a merits review tribunal such as the Administrative Appeals Tribunals;

  5. Providing assistance in preparing a request for the Minister to exercise certain powers under the Migration Act.

A migration agent cannot, however, do the following:

  1. Your outcome cannot be influenced by them;

  2. It is not possible for them to expedite the process for you; and

  3. Visas cannot be guaranteed by them.

You should always seek advice from a registered migration agent if you are unsure of the process, criteria or your obligations. You must notify the Australian Government if you choose to use a registered migration agent to assist you with the process. This can be done by completing and having you sign the following form:Form 956 Advice by a migration agent/exempt person of providing immigration assistance This allows the government to discuss your application with your migration agent directly and to request additional information about your application. As your authorized recipient, your migration agent will also receive written communications regarding your application directly from the government, relieving you of some of the stress.

Is my Migration Agent registered?

The Migration Agents Registration Authority (OMARA) can be contacted to find out if your migration agent is registered.
